Update (19 April 2018): Apparently DiversityInEd was posting the general non-discrimination policy for clients particularly associated with an online job fair that was held on April 11th.  Although I did call it to LCPS school board members’ attention twice, nothing was done about it.  An email was sent to the LCPS supervisor for recruitment, and she promptly responded:

I appreciate and your concern.  LCPS participated in a Virtual Job Fair on April 11 with DiversityinEd.com.  As part of the fair, DiversityinEd.com selected a number of LCPS job postings and added their own non-discrimination language instead of using our posting language.   It appears that DiversityinEd.com did the same for other participating school divisions.  We have been in contact with DiversityinEd and have asked them to correct this error.

I called DiversityinEd to figure out why they were tacking on this policy (they’re out of Texas, mind you). I explained that this was setting up a liability situation for those school districts whose nondiscrimination policies do not take into consideration “gender identity or expression” (what a ridiculously amorphous concept, I cannot say it enough). It really does open them up to lawsuits since it sounds like legal language:

All qualified applicants will receive consideration for employment without regard to…

I was told that the company would start communicating better with their clients about their districts’ specific nondiscrimination policies. I was glad to hear this–anything to save taxpayers from having to fund an expensive civil rights lawsuit–but I cannot help but wonder why I had to do this leg work in the first place…


Loudoun County Public Schools (or someone acting in their name) pays for an employer account at DIVERSITY in Ed and currently has over a dozen listings.

What caught my eye was the last paragraph featured on every job listing that appears to be in direct conflict to the nondiscrimination policy approved by the board last year.

Here is the official LCPS policy:

But notice what is changed/added to the DIVERSITY In Ed listing:

  • affirmative action/ added to equal opportunity employer
  • removed any mention of adherence to federal and state law
  • sex changed to gender
  • gender identity or expression and sexual orientation added to the statement

Employer accounts are not free–either a private person is paying for a fake LCPS account or taxpayers are covering the fee. Clearly someone is posting these listings in direct contradiction to the school board’s stated policy. And it was a recent posting:

I notified a school board member who is looking into the situation.

Update: This looks to be a new practice. A job posting from 24 days ago has nothing about LCPS hiring policies:

So, who posted the job listings on March 25, 2018? And why add an altered hiring policy? Was it a new requirement of the website? It is not a requirement of the Diversity in Ed recruitment site. Or is someone trying to instigate a lawsuit on LCPS?
